Access to and use of the Website www.inglebygallery.com and www.inglebygallery.com and ingleby.culturelabel.com any one of which will be referred to as (“the Website”) is subject to the following terms and conditions:
Definitions and Interpretation:
The term ‘Ingleby Gallery’ or ‘us’ or ‘we’ refers to Ingleby Gallery Limited whose registered office is 15 Calton Road, Edinburgh EH8 8DL. Our company registration number is SC283134 (Registered in Scotland). The term ‘you’ refers to you, the user or viewer of this Website. The term ‘Artist’ or ‘the Artist’ refers to the maker of an artwork that may be illustrated or promoted within the Website. Words importing any gender include all other genders. Words importing the singular number only include the plural number and vice versa. Words importing individuals include legal persons and vice versa.
We have set out below the terms and conditions which apply to information shown in the pages of Ingleby Gallery’s Website and e-commerce facility (“the Website”) and to the ordering of any products from the Website.
By using the Website and/or placing any orders, you agree to and accept these terms and conditions without qualification:
a) The material in the Website is copyright to Ingleby Gallery or the Artist or our content and technology providers. You are welcome to view, print and download the contents of the Website for personal use, but not for any commercial purposes or re-publication.
b) The content of the pages of the Website is for your general information and use only. It is subject to change without notice.
c) Neither we nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials found or offered on the Website for any particular purpose. You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.
d) Your use of any information or materials on this Website is entirely at your own risk, for which we shall not be liable for any consequential losses or damages (direct or indirect). It shall be your own responsibility to ensure that any products, services or information available through the Website meet your specific requirements.

3. Website Information
a) We have tried to ensure that information provided in the Website is accurate. However, we make no representation and give no warranty or guarantee, of any kind in respect of the information.
b) We do not accept liability for any losses or damaged (direct, indirect or consequential) which may arise from reliance on information contained in the Website or in respect of any error or omission, except in relation to death or personal injury caused by our negligence.
4. Description of Products
a) The description and specification of products in the Website is only approximate and we reserve the right to make changes, without notice, which do not materially affect the quality or performance of those products.
b) We may correct any error appearing in the Website or withdraw any product from sale without notice and without incurring liability. Price and availability is also subject to change without notice.
c) The colours depicted in paintings, artworks or articles on the Website may not be accurate, due to the nature of both computer operating system colour palettes and computer monitor displays.
a) You may order products from the Website by submitting a completed order form through the checkout procedure.
b) We will confirm acceptance of your order by email to the address you have given and the sending of this email (whether or not it is received) makes the contract between us. Only order acceptance email from Ingleby Gallery is contract forming.
6. Price and Payment
a) The price of the products will be the price quoted in the Website at the time we accept your order. The price will include any applicable Value Added Tax (at the prevailing standard rate), but not the cost of delivery.
b) In addition to the price, you will have to pay our delivery charges as quoted in the Website at the time we accept your order – unless you qualify for free delivery. The amount of these charges varies according to the country of the delivery address you specify in your order.
c) You are responsible for any Import Duty or Taxes together with any advancement fees or administration charges levied by the carrier that may fall due and payable to the carriers, authorities, governments or agents in the Country of final destination.
d) For items that are not sold through the Own Art scheme, payment is taken by our preferred electronic payment provider, Moneybookers, at the time we accept your order. The credit and debit cards we accept are listed in the Website at the time you place your order. Refunds will generally be made by means of a credit to your electronic payment account.
e) Finance options through the Own Art scheme are subject to status. Additional terms and conditions apply. Applicants must be at least 18 years old. Ingleby Gallery is a licensed broker of Own Art loans with a registered address at 15 Calton Road, Edinburgh EH8 8DL. If you apply to buy items through Own Art, you will be automatically transferred to a site managed by Hitachi Capital (UK) PLC. Full terms and conditions relating to this payment method are available to view on that site in advance of proceeding with your application.
a) We will arrange for delivery of the products you order by the method and to the address which you specify in the check out procedure. However, the time for delivery will not be essential to the contract between us.
b) If you do not take delivery of the products or supply inadequate delivery instructions, we may cancel your order and retain the products. In this event, we will refund you the price of the products, but you will still be liable to pay any delivery charges and any administration, advancement fees or Import or Export Taxes properly levied.
c) If there is an error or any other delivery problem in respect of the products ordered, you must notify us in writing within 14 days after the delivery date. An email to our contact address will be accepted as written communication, however you must take reasonable efforts to ensure that we are in receipt of your written communication. We will not be liable for any loss or damage if you fail to do this.
a) The Contracts (Rights of Third Parties) Act 1999 shall not apply to any contract between us, so that no contractual rights are conferred on third parties.
b) Any contract between us shall incorporate these terms and conditions and be governed by and construed in accordance with the Law of Scotland and you hereby submit to the exclusive jurisdiction of the Scottish Courts.
9. Cancellation and Returns
If you are not satisfied with the goods, or have changed your mind, you have the right to cancel your order within 14 days of the receipt of the goods. In order to cancel, you must notify us in writing by email (email@example.com) or post or by hand-delivering the notice to our registered office, telling us that you wish to cancel the order and your reasons for cancellation.
Please note, if you have chosen to finance the purchase of goods using an Own Art loan, if you cancel the order, your credit agreement with Hitachi Capital (UK) plc will be cancelled. However under the terms of the credit agreement you also have a separate right to cancel the credit agreement as your preferred means of payment within 14 days from the date on which you signed the agreement.
You must return the goods to us in the condition in which they were received. You will be responsible for arranging the safe return to us of any unwanted goods by the same means they were delivered to you to our registered address. The costs will be your responsibility, unless you have cancelled the order because the products are faulty or damaged, in which case we will pay these costs.
If you cancel the order you will be entitled to a refund of the purchase price of the product(s) within 30 days after you have notified us of the cancellation.
Your use of this Website and any dispute arising out of such use of the Website is subject to the laws of Scotland.
